Preamble

Coaching is a voluntary, active, and self-responsible process. The coach accompanies the client as a process facilitator and catalyst for change — the actual work of change is performed by the client. Specific outcomes cannot be guaranteed.

Coaching takes place on the basis of cooperation and mutual trust. The coach discloses the methods applied, their purpose and mode of action, as well as potential risks and outcomes, at every stage of the coaching process.

The client should be willing to critically examine their own values, engage with their personal situation, and reflect on their own behaviour.

§1 Scope of Application

These Terms and Conditions apply to all coaching programmes, individual sessions, mentoring, and related services offered by Ralph Schönleber — Next Is Yours — delivered online (Zoom) or in person (Cologne).

§2 Contract Formation

The contract is formed upon written booking confirmation or digital acceptance of an offer. By booking or accepting an offer, the client acknowledges these Terms and Conditions.

§3 Scope of Services

The scope of services is defined in the respective offer or coaching agreement. This includes 1:1 coaching sessions via Zoom or in person, as well as accompanying materials as agreed. Rescheduling is possible provided the substantive value of the programme is preserved.

§4 Responsibilities

Coach's Responsibilities

The coach is obligated to:

• Not disclose confidential information to any third party outside the coaching relationship

• Use confidential information exclusively for the purposes of the agreed coaching engagement

• Store written documents and notes in a manner that prevents access by third parties

• Apply all available methods and techniques for the benefit of the client

• Refer the client to a suitable coach or specialist if unable to conduct the coaching appropriately

Client's Responsibilities

The client acknowledges that:

• They bear full personal responsibility for their physical and mental health throughout the coaching engagement

• All steps and measures taken within the coaching process fall within their own area of responsibility

• The coaching agreement does not entitle the client to any other advisory services (e.g.

therapeutic, medical, or legal advice)

§5 Payment

Payment is made by bank transfer in advance prior to the first session. Instalment payments are possible and will be agreed upon separately in the offer.

All prices are net prices pursuant to §19 German VAT Act (Kleinunternehmerregelung — small business exemption). No VAT is charged.

§6 Cancellation & Rescheduling

Individual Sessions

Cancellations are free of charge up to 48 hours before the scheduled session. Cancellations made after this deadline or non-attendance will be charged in full.

Justified exceptions (upon request with appropriate evidence):

• Sudden illness

• Accident

• Bereavement

The determination of whether a justified exception applies is at the coach's reasonable discretion.

Coaching Programmes — Withdrawal & Payment Obligations

A programme may be terminated at any time in writing (by email). Sessions already completed must be paid for in all cases. For services not yet rendered, the following applies:

a)  Justified exceptional circumstances:

If one of the following reasons applies (in writing, with appropriate evidence), 50% of the remaining instalments are due:

• Commencement of psychotherapeutic treatment

• Serious, unforeseen illness (supported by medical certificate)

• Bereavement or serious illness of a close family member

• Comparable extraordinary circumstances, at the coach's reasonable discretion b)  All other cases:

If a programme is discontinued without a justified exceptional circumstance, 100% of the remaining instalments are due, regardless of how many sessions have already taken place.

In exceptional individual cases, a mutually agreed solution may be found. There is no legal entitlement to such an arrangement.

§7 Right of Withdrawal (Distance Contracts)

For online bookings, a statutory right of withdrawal of 14 days applies in accordance with §312g of the German Civil Code (BGB).

With the client's explicit consent at the time of booking (active checkbox, not pre-checked) and a request for immediate commencement of services, the right of withdrawal expires upon completion of the first session (§356 para. 4 BGB). Until the first session takes place, the client may withdraw free of charge, provided no service has yet been rendered.

☐  I have read and accept the Terms and Conditions. I expressly request that the first coaching session commences immediately, and I acknowledge that my statutory right of withdrawal expires upon commencement of the first session (§356 para. 4 BGB).

§8 No Distance Learning in the Sense of the FernUSG

The coaching services offered by Next Is Yours do not constitute vocational training or continuing education within the meaning of the German Distance Learning Protection Act

(Fernunterrichtsschutzgesetz, FernUSG). No professionally qualifying qualifications or certificates are awarded. The content is intended exclusively for personal and professional development and reflection.

§9 Technical Disruptions

If a session cannot take place due to technical issues on the coach's side, a complimentary replacement session will be arranged. If technical issues occur on the client's side, the session is deemed to have taken place provided the coach was fully available.

Both parties undertake to report technical problems immediately and to arrange a replacement session promptly. The technical requirements for participation (stable internet connection, Zoom access) are the client's responsibility.

§10 Confidentiality

All content of coaching conversations is treated as strictly confidential. Anonymised examples may be used provided no conclusions can be drawn about specific individuals. This also applies to written documents and notes.

§11 Disclaimer of Liability

Coaching does not replace therapy, medical treatment, or psychological counselling. No guarantees of success or specific outcomes are given. The client remains solely responsible for their decisions and actions at all times.

§12 Intellectual Property

All methods, materials, and documents used in the coaching are protected by copyright and remain the property of Ralph Schönleber — Next Is Yours. Reproduction, distribution, or publication without express written permission is not permitted.

§13 Data Protection

The processing of personal data is carried out in accordance with the privacy policy at nextisyours.com:

The coach stores personal data only to the extent required for appointment scheduling, invoicing, and accounting purposes.

§14 Governing Law & Jurisdiction

German law applies. The place of jurisdiction for all disputes is Cologne, unless the client has no general place of jurisdiction in Germany or relocates their place of residence abroad after conclusion of the contract.

§15 Severability Clause

Should individual provisions of these Terms and Conditions be or become wholly or partially invalid, this shall not affect the validity of the remaining provisions.

Amendments or additions to these Terms and Conditions must be made in writing
